Because assisted living is defined differently from state to state, each state has its own rules and regulations governing the assisted living residences and the services that may be offered. Assisted Living residences in Massachusetts are certified and regulated by the Executive Office of Elder Affairs. Together, the assisted living statute and related regulations provide a process for certification for assisted living units and services and minimum standards and guidelines. In addition, the Nurse Practice Act, the Consumer Protection Act and anti-discrimination laws also pertain to the operation of assisted living residences.
